The Copyright Alternative in Small-Claims Enforcement Act, known as the CASE Act, was enacted on December 27, 2020. The act creates a three member panel, the Copyright Claims Board to handle small copyright claims. Join this program to learn more about what this means for libraries.

Our speaker, Dr. Tomas A. Lipinski, will review the CASE Act provisions and procedures. The session will include general liability and protections for libraries under existing law. In addition, he will target the CASE Act provisions designed to address fears of copyright trolling. The advantages of participation in the process will be discussed. He will briefly review the existing service provider protections that are available to libraries, as well as the new small claims process that allows copyright holders and users to send a take-down notice or counter-notification to bring the matter before the new Copyright Claims Board. He will touch on the likely regulations the Copyright Office may issue in the coming months.

Professor Lipinski is the Dean of the School of Information Studies at the University of Wisconsin Milwaukee. He completed his Juris Doctor (J.D.) from Marquette University Law School, received the Master of Laws (LL.M.) from The John Marshall Law School, Chicago, and the Ph.D. from the Graduate School of Library and Information Science, University of Illinois at Urbana-Champaign. Dr. Lipinski has worked in a variety of legal settings including the private, public and non-profit sectors. He has written many articles, book chapters, and monographs on the law and libraries.
